making the check or money order out to the land owner might help lessen the chance of this (yes I know a bit late in this case)

Man, I hate that for you. Really isn’t much on the legal side that you can do to recover what was stolen but worth a shot.

There have been a lot of comments about not posting on the internet and just “taking care of it”. I know some people just talk but I’m 100% positive that is exactly what would happen on our lease. Money wouldn’t be an issue to fight it the legal route but they would have to find the thief because he would be preoccupied and hoping the law found him.

I know this for two reasons…One, a few years back we had a family of morons get off and they stole our outhouse (and not a good one) and at one time there was talk of burning down their camper and house. Two, I am the one that collects all the checks and pays the rancher directly.

I am not an easily intimidated person but I would be terrified

Wonder if simply making use of the "For" line on a personal check could result in courtroom evidence that embezzlement has occurred?

If a check was written, I’d call the bank and say it was stolen.

unfortunately if the check was written out to the "lease boss" it was really not stolen in the eyes of the bank....the money was stolen, but that is a civil court issue not an issue where a check was written to a landowner and the lease boss just went and deposited it into his account because "well he is handling things".....I don't think the bank would allow that anyway

now if the lease boss turned the check over and endorsed it to himself after it was made out to the land owner that is a forgery crime....I am not sure the bank would return the money, but the cops would act a lot faster on that than just what looks to be the civil court issue that has happened with a check written for a purpose to a person that never took the proceeds from that check and completed the transaction the money was intended for
