The law, known as S.B. 4, makes it a state crime for migrants to illegally cross the border and allows Texas officials to deport undocumented individuals. It was passed last year amid a historic surge in border crossings — part of Gov. Greg Abbott’s (R) push to expand the state’s role in immigration enforcement, which historically has been a federal responsibility. The Supreme Court’s decision was divided and preliminary, with two justices in the majority urging a lower court to quickly decide whether to allow the law to remain in effect while appeals continue. That approach drew dissent from the three liberal justices, two of whom said the majority was inviting “further chaos and crisis in immigration enforcement.” “The Court gives a green light to a law that will upend the long-standing federal-state balance of power and sow chaos,” wrote Justice Sonia Sotomayor, joined by Justice Ketanji Brown Jackson. They noted that a lower court judge had concluded that the law "is likely unconstitutional.” Texas Attorney General Ken Paxton called the high court’s order Tuesday a “huge win” and defeat for the Biden administration and said the measure is “now in effect.” The statute imposes state criminal penalties of up to six months in jail on noncitizens who illegally enter Texas from Mexico. Anyone accused of reentering the country illegally could face felony charges. Lawmakers also empowered state judges to order deportations to Mexico — without Mexico’s consent — and allowed local law enforcement personnel to carry out those orders. Judges may also drop state charges if a migrant agrees to return to Mexico voluntarily.

Ken Paxton is a patriot, just like Donald Trump is. The RINO’s and their democrat allies have fought them every step of the way to making America great again. I watched the Ken Paxton impeachment trial, a lot of it a couple of times, it was a total joke and waste of tax payers money, it was a circus and Andrew Murr and Dade Phalen were the clowns, they looked the part. Trump and Paxton are true Americans.

If you have a felony guess what you arent getting? Ken is playing chess and Biden checkers. Only thing Biden can do is blanket pardon or ease the “no criminal background” requirements.

This should have been done about 40 years ago.
Previously it was a Federal (only) crime to enter the U.S. illegally BUT it was only a Civil Crime (first time) with only civil penalties (not criminal).
Second offense could carry criminal penalties but the usual solution was simply to deport. Then that person would be BACK in the U.S. before deportation officer even got home that night. Been like that for decades.

Texas has always had the right to arrest them. Trespassing is a crime in all states but it get's interesting in Texas since our border extends to the international border with Mexico. If they cross anywhere other than a Port of Entry in Texas, it's trespassing. NM, AZ and CA's border stops 60 ft short of the International border with Mexico. They can cross into the US and if they stay within that 60 ft buffer zone, they never set foot on state property, that buffer zone is Federally owned. They wait in that zone and a CBP uber will be along shortly to shuttle them to a be processed and released under the protection of the Federal Government. Those states can arrest them for trespassing but it has to be outside the Federal 60 ft buffer zone. That buffer zone was created in 1907 through the Roosevelt Reservation. Those states gave up 60 ft of their southern border with the agreement that the Fed's would handle all smuggling and immigration issues. With this SCOTUS ruling the Texas border is fixing to get quiet again as per illegal immigration, but NM, AZ and CA are fixing to catch the flood. Might add that their in a piss poor position to do anything about it. This doesn't mean they won't be spilling across the Federally owned Port of Entry's in Texas.

The way that I understand what happened yesterday is that the Supreme Court decided to not hear the case therefore allowing the law to go into effect. However, Justice Amy Coney Barrett made remarks that it was to early for the supreme court to interven and they may after the 5th Circuit weighs the merits of the case. So basicly they kicked the can down the road allowing the case to make its way through the normal court system. They have done this in some of the Trump cases as well letting them go through the normal channels before getting involved. Now we wait to see what the 5th Circuit will do and if they rule in favor of Texas and it is appealed to the Supreme Court will they take the case up. If they do it looks like the case will hing on how Barrett and Kavanaugh rule then again Roberts could throw a curve as well.
