Small claims court. Everybody that paid him and had their money stolen needs to start at small claims court. Then, you might actually get the attention of the local DA, but don’t hold your breath.

Not all DA’s offices, actually Dallas is the only one I know of, has their thumb on the warrant process from law enforcement agencies. Depending on the totality of the circumstances, you might go by the Sheriff’s Office and see if they believe it’s something they would investigate and hopefully issue a PC warrant. The worst they can tell you is that it’s a civil matter.

Sure why not.

Because he could report his property stolen. Bad idea. Play this out in your head. He reports his property stolen, names you as a suspect, officer asks you if you took, and sold his property, you answer yes and start to explain why you felt that you had a right to his stuff as you are placed in handcuffs, charged with a felony.

I always assume theres another side to the story. Does he have some type of excuse or is it just blatant theft? If you want sincere help you may want to offer some details.

Also, something to consider when going the legal route, it will cost you way more money to get the money you put in back out, if you even get that money back. The lawyers always make the most in any kind of lawsuit, whether small claims or big claims. And just getting an award or judgement against someone doesnt mean squat, getting tangible money out of that award or settlement then costs you a lot more money. Usually you will spend hundreds if not thousands to get a couple dollars back, so factor that into any direction you want to go...

OK, steal a couple of vehicles, sell them, then lie about it. More bad advice.

If someone rips you off in a business deal, that sucks and there are remedies. Becoming a criminal to settle a debt with a criminal isn't a good idea.

As for my experience with Small Claims Court, I don’t know why I even bothered. If you do try that approach, do it in the county where the theft was made. You’ll show up at the court but the thief won’t. The judge will quickly rule in your favor. And then….and then. You won, but how do you get your money. If he lives in that county, you might have a chance if the county cops are bored. Maybe.

As I said, just becasue you won an award or a judgement dosn't mean squat....you will end up spending gobs of money to get pennies.

Unless this was a lease that the payment was in the hundreds of thousands, IT AINT WORTH IT.

Even tens of thousands it isn't worth it. Lawyers fees alone eat that in one day, and I guarantee it will take a lot long than a days work to get anything done.

Sounds like enough money to be felony fraud-I'd talk to the DA.

They do....

Or preferably catching the POS Face To Face and making sure that he does not leave without giving you your money back. I'll follow you to an ATM but you are not driving away until you make things right type of deal.

This has happened. The ONLY reason why things were made right was through the threat of physical force face to face. People that do [censored] like this are scumbags and should be treated accordingly.

That's my take, carry on...

popcorn...entertaining! Can't wait for the ending.

Moving forward...get everything in black and white including receipts. Names and addresses are probably important as well. Days of hand shake agreements are long gone for the most part.

Good Luck!

The person over a lease I was on in Brown County did the same thing. At the end of the season, he told us we had lost our lease and we needed to get our stuff off ASAP after the season. The land owner was a woman that was nearly 80 years old. She showed up when I was getting my blind and told me that he never paid her the money for the season that we had just hunted. She said she knew we had all paid him or we wouldn`t have been there and she didn`t blame us. What a real POS. His name was Ron Day from Burleson.

justice of the peace court, 10k max. claim, no lawyers allowed, you, accused, witnesses, documents.

cost me 111.00 when I used it.

if you win the jp will give them x number of days to pay, not done by then you have the right to send a sheriffs deputy to repo anything needed to equal the amount.

might look into going that route.

hopalong, you are talking about small claims court but lawyers are allowed. They usually aren't used because of the smaller settlements. My elderly parents used a lawyer, won the case and the other party had to pay the 650 dollar lawyer fee.

If the guilty party does not live in the county where the crime occurred, there won’t be anything to repo. That’s what happened to us.

making the check or money order out to the land owner might help lessen the chance of this (yes I know a bit late in this case)

Man, I hate that for you. Really isn’t much on the legal side that you can do to recover what was stolen but worth a shot.

There have been a lot of comments about not posting on the internet and just “taking care of it”. I know some people just talk but I’m 100% positive that is exactly what would happen on our lease. Money wouldn’t be an issue to fight it the legal route but they would have to find the thief because he would be preoccupied and hoping the law found him.

I know this for two reasons…One, a few years back we had a family of morons get off and they stole our outhouse (and not a good one) and at one time there was talk of burning down their camper and house. Two, I am the one that collects all the checks and pays the rancher directly.

I am not an easily intimidated person but I would be terrified

Wonder if simply making use of the "For" line on a personal check could result in courtroom evidence that embezzlement has occurred?

If a check was written, I’d call the bank and say it was stolen.

unfortunately if the check was written out to the "lease boss" it was really not stolen in the eyes of the bank....the money was stolen, but that is a civil court issue not an issue where a check was written to a landowner and the lease boss just went and deposited it into his account because "well he is handling things".....I don't think the bank would allow that anyway

now if the lease boss turned the check over and endorsed it to himself after it was made out to the land owner that is a forgery crime....I am not sure the bank would return the money, but the cops would act a lot faster on that than just what looks to be the civil court issue that has happened with a check written for a purpose to a person that never took the proceeds from that check and completed the transaction the money was intended for

Where I come from, things like this are settled off-line and not talked about.

Good luck to you.
