An employee of mine was arrested yesterday. We are off work this week and it had nothing to do with work. I saw his mugshot and the charges on Facebook I guess they post all the arrests there.

Is the actual report that lists the details of the arrest public information? I am leaning towards terminating his employment due to this but I am wondering if it is possible for me to get more information to help make the decision.

Generally the report is not publicly released.

County will usually have a jail roster and charges.

Innocent people get arrested. Just because he got arrested, does not mean he is guilty. That said, most of the time, people that get arrested probably are guilty. Were you thinking about firing him already and are just looking for an excuse? Texas is an at will state. You don't need a reason to fire him if you were already thinking about firing him.

Because of the severity of the charges. Apparently he ran from the cops so there is evading arrest and then he had fentanyl. I am not some super uptight person I don’t care if people want to smoke weed in their off time but hard drugs aren’t normally the kind of thing you just do recreationally and people lots of times are addicted and it carries over into the workplace, I don’t want someone who uses that working for me.

I have 5 employees and other than this guy the others have been with me from 7 to 14 years. This guy that got arrested has been with me 6 months.

I can understand your stance on that if he did it. How would you feel about firing him if he didn’t do it?

If he's guilty I would sit him down and give him ONE chance to change, help him if you can maybe especially if he's young. Sometimes young folks make really bad decisions and don't have anyone in their life to guide them along the way. FME some of these guys turn out to be great hands down the road........but most of the time they are not.

Give him a chance to explain himself and fire his azz if he doesn't straighten up.

FYI - I always wanted to run from the cops, like the Duke's of Hazzard. grin but I've only ran from the Game Warden.

I wasn’t contemplating firing him before this occurred if that is what you are asking. He does his job. Not great, not horrible, but average. Whether he is actually guilty or not I don’t know. It seems pretty unlikely to rack up all those charges and run from the cops if your weren’t guilty. Also the fact that he has been to prison for drugs in the past makes it even more probable. He isn’t a young guy either he is in his 40s.

The way our judicial system works it could be years before he has a trial for this. If I reasonably believe he is guilty I can’t have him driving the company truck around and endangering everyone if he is using while I wait on a trial.

Down here they post arrests on Facebook everyday...but only if you are a member of a certain group. Sorry, I didn't understand the post correctly, yes, the details would probably not be available.

The full police report and arrest affidavit are available with a freedom of information act request but will take some time. Certain details will be redacted for legal and privacy purposes. 1-4 grams of PG1 dope and felony evading is all I would need to see. A probable cause determination that he did it has already been made by the arraignment magistrate.

This changes my stance. If he's known to have drug problems in the past, then he's already used up his benefit of doubt card. Like I said earlier. Texas is an at will state. You don't need a reason to let someone go.

I don't know what kind of work you do but one doper can ruin an entire crew. Keeping one around is never a good idea. If your worried about being fair give the guy 2 weeks severance and wish him well. That will be better than anything anyone else has done for him before.

Dumb question but how many people who get caught with fentanyl don't realize they had fentanyl in their possession and thought they just had a hydrocodone or something?
