Just a heads up - avoid this place like the plague.

Absolute worst car buying experience I've ever had - probably about to have to hire an attorney.

Traded in my wife's 2019 Explorer on 9/30 - got her a new VW Atlas. All of that went well.

Get home and realize there is no key for the wheel locks. Took two weeks for them to figure it out and send us a new one - had to constantly bombard and remind them. Wife couldn't really drive the car because they're the type of locks you can't get off without the key unless you want to weld a nut onto the end. So if she got a flat she'd be SOL

Thought everything was resolved.

As of today 10-22 her Explorer has not been paid off. I think they "technically" have 25 days...so Monday. HOWEVER - they sold the Explorer a week ago. I can still track it via the Ford App. So someone is out there driving around in a car that is still legally titled in our name. I have NEVER had a dealer take more than 2 weeks to pay one off. I buy new vehicles every two years and this is the first time I've run into this - had one take 20 days - but it was no big deal since they were glad to communicate.

I guess if they don't pay it off by Monday (the 25th day) I need to lawyer up. Can't get anyone over there to call me back or own up to WHY the vehicle hasn't been paid off - and how it's been sold because since it's not paid off Ford Motor Credit obviously has a lien on the title - and a new title can't be issued to the new owner.

Sounds like a cash flow issue. Kiting titles. Playing the float to the max. They have their money on your new purchase. Watch for toll fees, parking tickets, etc., and other liabilities associated with ownership. That sucks. Google Reagor Dykes Auto Dealership. They are going to jail.

I know in Texas that owners are liable in accidents. However, in this case I imagine you are fine if there is a wreck and the VW dealer will be on the hook.

However, what jetdad just said brings back memories. I spent HOURS convincing toll authorities all over TX that I sold a car. What a PIA!

You need to fill out and file form VTR346 within 30 days of selling the vehicle to avoid problems with the State of Texas.

Form VTR346

This does not help with the pay off, but it keeps you from having problems with toll roads and other governmental BS.

Don't be afraid of your own shadow. Just what harm have you suffered? Btw, you already said it - you have a legally binding contract. I'm going to "lawyer up" is no different than when you told guys you were going to call your mommy.

Quit trying to call, put it in writing and don't act so dang desperate. You are the one who chose to do business two hours away so deal with it.

This doesn’t sound like a big deal at all. Especially not a situation where you need to “lawyer up”. You even said yourself that they still have time.

Maybe go speak to the General Manager (politely) and lay everything out. No lawyer is going to work on this chicken chit cause.

OP, it happen's a lot with car dealers. I got burned by Gene Messer Ford a couple of weeks ago buying a used truck via the internet that I needed in a hurry, trusted that the salesman was honest, he wasn't. Called the dealership to see if they would make it right, they won't. I paid to fix the problems and move on, still cheaper and easier than an attorney.

It is just what JetDad said, they are floating it hoping someone buys it before they are required to pay it off so they can use the buyers money and not theirs. File the VTR346 and ride their [censored] daily, no point in wasting your time/money with a lawyer. Call your bank and confirm it has not been paid off after the 25h day and if it has not file a complaint here-
