Is it legal to shoot an elk that has escaped from a high fence that has no ID marks? I know it may not be ethical if you know where it came from however is it legal? I ask because one escaped from an area ranch and came on us and the question about legality came up . The elk has since been captured and returned home . Who knows the correct answer. I haven't had a chance to ask a GW yet.

Somebody may correct me, but if there's no tag, it's absolutely legal. How are you supposed to know if it's feral or a recent escapee?

Shooting your good(assuming property owner permission were your hunting)
Possession is another issue. If rightful owner can prove its his/her you will loose meat and head. But no other recourse other than that

Well they started out with horses and that didn't work so the owner got in his helicopter and darted it . Yes it was an all day event. It's not my lease it's the ranch I manage and that pasture is leased for hunting so yes they upset our hunters. I hunt another pasture on the other side of the ranch so my deer weren't bothered it may have drove some my way. The high fence owner is typical rich arrogant so and so.

yep shoot them all not my place to find the owner then what's to say it would still be there when they come for it, It is low fence after all! plus we have them all around our area who knows where to start?

I believe that estray laws only apply to animals classified as domestic livestock. Elk are not defined that way.
I believe you could have killed it even with a tag and kept it. I could be wrong, it's been sooo long tho.
No way would I have allowed a chopper over my place if I'm not in it. All kinds of bad things can happen.

From a quick discussion with a local Game Warden several years ago, I was told that if an exotic leaves your property, it can be taken by any legal means on whatever property it happens to be on. You only have a right to that animal when it is on your land. Once it's on another landowners property, that landowner has the right to do what he/she wants to with it.

We asked this same question to the Taylor County GW, as we have a HF exotic ranch across the road from us.
1. He said if the exotic had a identifying tag or brand you must at least try and establish who owns the animal and if successful, obtain their permission to shoot it. The best way to determine ownership is to contact the local GW.
2. You must have the land owners permission of the property on which it was shot.
Elk in Texas are not considered an exotic, BUT if they have a tag or brand, you must still obtain the animal owners permission before shooting it.
Lastly, he said if one of those axis deer from across the road were to wander onto our ranch and we shot it, we should call him so he could help us eat the evidence!

You did the right thing letting them reclaim the elk. But I also would have let them know that if they don't maintain the fences and it happens again, it's elk steaks for dinner.

Bottom line is you can shoot it if you LO says OK. Had this on our place in the Panhandle. It was about a weeks debate, phone calls, etc... Bang, bang, elk steaks for supper!
