Ok guys need some advise. We have a lease in Dimmit County, 2500 acres. Great place, big bucks, we are spoiled I know. Lease fees are reasonable for the area and we wanted to start feeding protein, just to kick it up a notch . We decided to go full bore with it but needed to add a 7th hunter to the place, to cover the cost.. One of the hunters knew a guy and he decided to join. We pay the payment in 2 payments due march 1 and September 1. I, through no fault of my own, send in the money, buy the protein and we all put it out, or we are supposed too. I ask the guys to have the money for the September payment in by August 15 so I could get the check to the land owners by the 1st of September. I sent out a reminder text the end of July. The new guy paid the first payment fine, but I hadn't heard from him all summer. Last week I began texting him but no response. Finally last Saturday the hunter that got him involved got in contact with him and he finally texted me he sent the check from the Bank Processing center?? Last Thursday, to my business po box. Checked the box today, nothing. I sent him a text that he had until Sept 1st to pay or loose his spot on the lease. A couple hours later I got a phone call from him, first time I ever spoke to him. He proceeded to tell me he would not set foot on the lease and demanded his money back, in very colorful but not appropriate language. I explained to him that was not an option as his money has been spent on protein. My thought is to refund his money if I can sell the spot, which I believe I can in short order. What do y'all think?? Sorry so long...

I would give the guy his money back...you probably don't want him around (at least I wouldn't)...might want to do some better "due dilligence" in the future...

I agree with the due diligence. We like to let only guys we know get on the place, I have 2 buddies on the place myself. The guy that got him on is suprised as well. A little over $8.00 per acre with everything.

I would refund the money and lease the spot. If he is a problem now, I can't imagine it getting any better in the future.

yep, sell the spot and after you sell spot then refund his money. let him know you will refund after you get the money from the new guy.
Send the money to him inside a kids Tinkerbell card.

from what read, the persons intent was too get on lease. payed half. doesn't say why didn't pay rest. lots of left out info. Do what's right edit: the guy ever find out why second payment didn't reach ya, checks in the mail

I would have to collect from all the rest of the guys on the lease to refund his money, if we don't lease the spot, I don't think that would be fair to the hunters, myself included. As it is I'm going to have to collect a bit more to cover the money we have spent. Not whining just kinda torques me off that it turned out like this. That being said, we have another guy interested. I talked to him at length, sounds like a nice young man. Have any of you ever sent a check from a Bank processing center? that's a new one on me.

yep, sell the spot and after you sell spot then refund his money. let him know you will refund after you get the money from the new guy.
Send the money to him inside a kids Tinkerbell card. And if you don't sale the spot for the total balance ( as in half) he doesn't get a refund. The option to actually hunt the place would be off the table.

I would refund the money and lease the spot. If he is a problem now, I can't imagine it getting any better in the future. I would lease the spot then refund his money.

Return his money immediatly. Fill the spot and collect 100% of lease from new members upfront non refundable. Once the have history with you you can change it up. I am aware of a situation this August that all the sudden guys could not come up with the money etc. if you are taking the responsibility of managing the lease make it easy on you to avoid the BS. Some folks are funny about their money

Specifically any new member makes both payments up front, and collect the second half august I so you don't have to mess with it close to season.

We do it all of the time, all we do is enter the amount, payee's name and their address and my bank sends them a check. Only problem we ever ha was when we entered the wrong zip code, it took 2 weeks to get there.

This is a case study on several items on managing a lease.
First is always meet face to face with any potential member - ask lots of questions about their previous hunting experience, what they expect, etc. Your best new members are typically friends of existing members but still must meet with them so you can get a feel for if they are a fit for your group or not.
Also a strong reason to have a signed rules/lease agreement from each member. We do this each season - it clearly states in the agreement that their are no refunds. Now in this case if you can fill his spot then I might consider a refund - otherwise no way.

If and when you sell his spot, send his money back. If not, I would keep it and use it to pay for the lease. You don't want him around anyway. He is nothing but trouble in the short run and in the long run.

For those who don't already know, our mail system SUCKS!
I have a 500+ dollar check floating around out there somewhere for a truck payment I mailed. I don't even own the truck anymore. The check has not arrived has not been returned and has not been cashed. My bank told me the check was void now because it was stale dated? well that bs, they also said almost any check cashing place would cash it.

Let him know you'll pay him back when, and only when, you receive the money from the new guy. F him, he put you in this position, he doesn't deserve anything other than that. Looks like you'll be better off without him anyways. Sounds like the bi-polar idiot we just threw off our place last year, his name isn't Brad, is it?
