To me looks like he may have a brow tine on that side that you can kind of see against the beam/spike. Also its trying to fork.

If no brow tine then shooting him would probably follow the letter of the law but not the spirit perhaps?

In a non AR county we would shoot him on our place.

yep see the brow tine now. I think we have more than one like this.
The other doesn't have brow tine but the fork on the right side is almost identical. I will see if i can find another pic.

That may not be a spike with the small crab claw on the left side. But according to Texas Parks and Wildlife that would be a legal buck considering that little sticker on the left side does not appear to be a inch long.
