So you are not hunting, you are in a store and wearing camo.

What is the title of the ticket? Hunting without a license - in store

I don't believe camo is good probable cause

Not to get mixed up with consensual license showings. " Can I see your license"? 99 of us out of 100 will just show it.

Poor way of policing imo

I would let him know that I thought it was BS, show him my license, and write a professional email to about three layers of supervisors above him.

Funny, we were just talking about the jurisdiction and freedom that wardens have the other day. They can walk in your house, open up your freezer, check your birds, confiscate your blue bell ice cream, then be on their merry way.

On a serious note- if you've got your license, just show him. It's not that hard. Of course he's being a jerk, but refusing to cough up a license is only gonna make him more pissy.

Some people become wardens because they know they have a lot of power. Others do it because they love wildlife. One is generally nice, the other is a straight jerk

Not a legal expert here and for the record, I agree with just being pleasant and easy to get along with. For those that do not carry their license with them I can't imagine it would be an issue unless the warden was just trying to be a pain. There is no legal obligation to carry your license on you at all times. I know the idea in Texas and elsewhere is that wardens have power that cannot be checked however that is not true. Your 4th amendment right cannot be violated unless you let them.

What I caught in all of this was the GW asked to see your license, not demanded. These are two totally different things. A cop can walk up and ask you to do anything. Same thing as the breathalyzer and a cop asking for a sample of your breath. They are not demanding, they are asking. The exception to that is a no refusal weekend and a judge signs an order right away.

Me personally would have told him nothing, other than have a nice day Sir. I appreciate what they do but if he is asking me questions, he is no longer on a friendly status, he is investigating. I am not willing to play.

This ought to spin this way out of control. I have asked other officers what they would doing the government decided on gun control. My question to them is what would you do. There is an alarming amount of young officers that say they would do what they are commanded to do.

Before this gets way out there, I want to clarify my point. The point is there are people all through our country whom are clueless as to what the constitution says. Even policeman are allowed to pass an academy without ever reading the constitution. Slowly we are giving over our rights. Partially due to ignorance alone.

Really people. We do not know where he was at. Maybe he is from the country where the store means the local gas station next to the boat ramp.

I have never been cheked by a GW where i was not either going or coming from hunting.

Well it didn't happen to me, a buddy had it happen to him. And I'm not talking about in the parking lot of the gas station, it was in the lumber aisle of Home Depot. I guess the GW was in his rights to do it, but IMO it's a little unethical. Not sure what I would have done in that situation but I'm sure my mouth would've gotten me in a little deeper with him

If you don't have your license the GW can call Austin an get all your information. But you don't have to carry it if you are not in the act of hunting.

I would never tell him to pound sand. No point in it.

If I was in a hurry I'd just say no and move on.

If I wasn't and my buddy didn't shoot anything illegal I'd say yes and deal with it.

I never carry my license outside of hunting. He can call and look it up if he wants, but I'm not waiting for him to get his answer. He has no right to detain me, so I will continue on with my day. He can follow me around waiting on his answer from Austin if he wants, but I won't be standing there waiting with him.

Other than the camo, what proof does he have that you even hunt? What if you say you did not hunt that day, can he still check your license? What if you say you don't even have a license, what can he do? What is the GW even doing in Home Depot??

Nothing hard about it at all. I don't carry my hunting license on me when I am not hunting 9 out of 10 times. I have nothing to hide but this is right in line with an officer asking to search my truck. I will tell them no every time. Its not about being a tough guy, its about protecting my rights as a law abiding citizen. When I am afield and hunting absolutely I will present my hunting license but not when I am shopping at Home Depot. I would be respectful of course and simply decline his/her request.
