Theres several species of horned toad in the state, in some areas they are still doing pretty well. That one is a Texas Horned Lizard, one of the two protected species in the state... Technically it is illegal to "harass" them. What harass means is entirely up to Game Warden writing the fine, but it can be as simple as picking one up.
I don't think you've got much to worry about, but its something to keep in mind. There are one or two wardens I know of who would harass YOU for that.

We had a bumper crop of them at my place this year. I "HARASSED" these out of the front of my lawn mower.

I think our local game warden has bigger concerns than me. Now if I had turned that little feller over to my five-year-old little girl and two-year-old son, now that would be harassment!

Where did you find that toad? I have only seen 2 (that were running away) in the last 15yrs or so.

I grew up with these guys in East Texas but haven't seen one in 30+ years. Glad to see they are still around in some areas.
