I think it would weed out felons that use a trust to buy firearms. Finger prints thru database at atf, yes felon, no stamp.

Nothing but pure BS. Its ok for our military surplus weapons to end up in the hands of terrorists and Mexican Drug Cartel (see Fast & Furious) but not for Americans to own them in the States. What a crock. And guess what. Felons and criminals don't care about background checks or buying weapons legally; they just steal them. This will be headed to the bunker shortly.

I think you should have to go through a simple NICS back ground check for SBR and suppressors anyway. Wish this would just do away with the trust crap for NFA items.

Its not law yet.
It would just make you get fingerprinted etc with your trust. A benefit though is that it completely eliminates the cheif LE signature.
Hope it doesn't pass, but who knows.

Good point on the dismassal of the LEO signoff requirement. I think I answered my own question... If I don't need to create a trust, then the ATF will have my fingerprints, my picture and will be able to run an NICS check on a breathing person rather than simply know the address of a trustee or beneficiary of a legal entity person and my CLEO will know where the NFA items are. Aside from the fact that my federal representatives are not involved in this at all, I presume this to be a unilateral, cabinet-level measure and there is some rhetoric suggesting that the ability to get really great surplus weapons through the CMP may go away, I don't really have a huge problem with the BATFE knowing what I look like and where my silencer is. There has been a de-facto registry for NFA items since 1934 and no one has gone door-to-door to collect them (yet). Its arguable that the information necessary for a registry is compiled every time an NICS check and FFL transfer is performed. If the NSA can moniter 75% of the nation's electronic communications simultaneously, why would anyone think that their firearms purchase history is privileged information? This should actually make the acquisition of NFA items more affordable for most people, you just have to trade some information - like you do going through the CHL process.

A trust also allows for your Title II firearm to be in the possession of any trustee which is a huge benefit to families. My trust has me, my brother, my dad and our wives on it, which allows any of us to be in possession of any of the items in the trust but more importantly, it allows our wives to purchase NFA items for gifts.
Just to make sure that it is done thoroughly, I go both ways.

The question is how would they verify that the CLEO was sent the copy? If they require the CLEO to verify that may be a way the CLEO can prevent you from getting any NFA items...

Update from several sources inside the suppressor industry:
Applications that are in process with the ATF will proceed under existing rules.
They will be fighting this tooth and nail, the Silencer Shop has hired an attorney to fight it.
I am about to submit my paperwork for 3 cans with a trust, was going to be 2 but I decided it best to bite the bullet and get another one to make sure I could.

SmittyB: For about a week or so, the language of the proposed rule change included the elimination of the CLEO signoff, I presume as a trade-off for the mandatory inclusion of background checks (which I think is fairly silly to begin with since the only way you could REALLY circumvent the background check would be to build your own silencer and place it in a trust). I never took a screenshot of that language and don't know how to retrieve it at this point, but it was actually part of the proposed rule change for a time. I think someone pointed out to whoever is drafting this garbage that this could be construed as "friendly" to the acquisition of NFA items. It was subsequently replaced with far more restrictive language that will, for most people in America, make the acquisition of NFA items functionally illegal and, probably, put a lot of shops out of business. This is really bad and there simply aren't as many people paying attention to it as there were after Newtown. I think this is going to happen and it isn't likely to be undone.

Yes, I am aware of this, I guess I just saw the recent posts were from yesterday and did not notice the earlier posts were a month old now. I have kept up to date with the happenings as they occurred, and I am blown away more people are not upset or even aware of the proposed changes.
