A BILL TO BE ENTITLED AN ACT relating to the intentional display of a handgun by a person licensed to carry a concealed handgun. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subsections (a) and (h), Section 46.035, Penal Code, are amended to read as follows: (a) A license holder commits an offense if the license holder carries a handgun on or about the license holder's person under the authority of Subchapter H, Chapter 411, Government Code, and intentionally displays [fails to conceal] the handgun in plain view of another person in a public place. (h) It is a defense to prosecution under Subsection (a) that the actor, at the time of the commission of the offense, displayed the handgun under circumstances in which the actor would have been justified in the use of force or deadly force under Chapter 9.

This is a catch 22. On the one hand, getting busted for accidentally printing would suck. On the other hand, if you make it legal to accidental print or flash, then every yahoo is going to be wearing his tightest clothes, so he can let everyone know he's carrying.
I say leave it as is, and just make sure you're concealing it properly. The whole point of CCing is to carry without anyone knowing.

There currently is no law against "printing", all this law is saying is that a CHL holder would only find themselves in trouble if they "intentionally displayed" their firearm. Thats a heck of alot better than fails to conceal.

I don't see it as a catch 22 either.

its already not illegal to print. Nor is it illegal to accidently display your firearm.

If it is accidentally seen your ok. PPl could / may / will, still freak out & call the cops because they saw " A MAN WITH A GUN" but after the cops talk with you they SHOULD let you go. Like I tell my classes.. If you know your pistol was seen LEAVE. come back another time. Save yourself a headache.
