Constitutional rights are not up for the taking. States rights can't infringe on Constituional rights. Pot is not covered by the Constituion and is a states right issue. Marriage is a states right issue (apparently DOMA can't or won't stop it). The right to keep and bear arms is not.

Under your premise if Texas were to become a blue state (highly possible after amnesty) and they wanted to limit everyone to a .22 single shot, it would be fine due to states rights?

Is the right to free speech a states rights issue? Somehow the 2nd is the only ammendment where (some Blue)states feel they have "rights".

We are a Constitutional Republic but we forget that. Otherwise the party in power could do as it wished unchecked against the will of the minority with no recourse. That is called Tyrrany.

Marriage, Abortion ( Supreme Court said its not a states right issue) Marriage ( does it or does it not fall under the pursuit of happiness) in your mind Pot may not but alcohol certainly does. ( go out in your back yard and make a batch of moonshine and see how long it takes the Feds to show up!
You can't just include the things you like and exclude the things you don't like.
I'm personally not a big states rights person on most issues but understand it does have a place in the mix! I don't care who you marry or what you smoke as long as you don't physically hurt any one.

Ofbhwg, who is picking and choosing? None of the things you mentioned are directly covered in the constitution. That's the difference. Tell me how states rights can over ride "shall not be infringed"? It is that way of thinking that is causing everyone all these problems in the first place.

Also the pursuit of happiness claim is not a end all be all. Speeding might make many happy but is not covered. As you can imagine the list of things that could make one happy and is illegal would be a long one.

What's going to happen to all the children that were prescribed medication? Parents who followed advice from their pediatricians may have just sealed the fate for their children. These laws are going to turn a lot of good folks into outlaws.
