State Rep Toth has just proposed a bill making it a Felony for any Federal agent to enter Tx and enforce any Federal Executive orders on the banning of weapons and magazines. With punishment being 5 years and a 50,000 fine. It is before State Atty General Gregg Abbott now. full story at radio.woai.com

Wyoming was the first state to propose such a bill followed by TX hope this gets some traction.

I hope so too. Not sure it would actually work though. I believe there is a law that states that if federal and state both pass laws that oppose each other then the federal law trumps state law. Not sure if that would apply in this circumstance or not. I'm curious to see where it goes though.

It sounds good on the surface. Unfortunately, whenever a conflict exists between state law and federal law, federal will prevail.

It is amazing to watch the different postings here on TWF. I saw one where a guy sold his AR because he didn't want to get into trouble with government. Then I hear that Walmart put a hold on restocking ammo.
I think we are in a state of tyranny already as the population has already began to fear the government.
It is supposed to be the other way around. We have become sheep.

Although thus may be true, I think it has more to do with STANDING UP and letting the states voice be heard. Also telling the fed gov that we are not happy and taking a stand by saying DON'T TREAD ON ME

I sure hope this assault weapons thing blows over. It appears as though it is going to get worse, tomorrow.
I hope Texas stands up against the Feds. If they do, it doesn't sound like it is going to be pretty.
We really need to support our Texas legislators.

There was an assault weapons ban before, to think that there will not be another, is being unrealistic.

i was going to say the same thing. my buddy lives in colorado, and he says that no federal marijuana law is being enforced... period. people are literally smoking weed outside of nightclubs, in their front yards, etc. the feds don't have enough manpower to police the states. it doesn't bother me anyways. i have gotten rid of every evil rifle i own. i now carry a .22 short derringer. thinking about carrying a blackpowder derringer instead. smile

The key here in this thread is about federal EXECUTIVE orders. Not LEGISLATIVE bills passed by Congress, which are the representatives of the people, (sic) states. Federal law can only supersede state law whereby the duly elected Senators and Representatives of the states pass such legislation. This is the balance of power, not only between the branches of the federal government, but between the states who make up the Union. The POTUS knows that he cannot legally overturn the Constitution, or amendments thereof. He can only go through due process, otherwise he would be in violation of his sworn duty and be subject to impeachment, and worse, removal from office.

An executive order is not law. Laws are written in Congress then voted on if approved they're then sent to the president, if he approves then it's signed and turned into a law.

The only chance this thing has is against EO, otherwise the surpremacy clause would nullify it. on the weed deal in colorado you just explained the difference between de jure and de facto laws. It really wouldn't surprise me if this wasn't just more saber rattling from austin, kind of like slick ricks secession talk every few years.

^^^^^ This. THe prez is not a legislator and can not write laws and make them Constitutional without Congressional votes. He can make recess appointments and decide to enforce existing laws by exec order. That's it.
