So I went to grapevine mall in DFW today...all of the mall entrances had 30.06 signs. However, entrances via stores like dollars, jc penny, etc don't have 38.06. In my hometown of Longview its the same thing. So, what happens if you carry in the mall, the unfortunate situation arrives that you have to use your weapon....do you just say you came into via one of the store fronts??? What would be legal by the letter of the law?

Lawyer would probably find your post on THF and since you were aware that the mall was posted and ignored, you would be in violation. Unfortunately, that's the world we live in.

Just remember all the cameras. No matter where you go in you are on camera. Make sure you enter through a door with no sign!

Could they say you were in violation once you enter the foyer? Legal in Dillard's etc but when you enter general mall territory then the sign applies?

Go to a different mall! I go where I can carry, especially malls!
There are many buildings around Dallas that have multiple entrances and only 1 or 2 have a 30.06 sign. I saw it on the way out also, when we came in a different entrance. Honestly, I don't know what the actual rule is. But I won't go there again for this reason. The antigun mgmt doesn't want me carrying, then I won't spend my money there, period.

The Simon Property Group one of the biggest mall owner/manager companies is virulently anti gun. Others are also anti gun. Their policies however can only be applied to the public areas of the mall. That is why you see the signs at the general entrances and not the anchor store entrances.

Inform the mall that they are putting themselves at a very huge liability if they are not providing armed security while telling you that you cannot be armed to protect yourself from criminals.

Did the law change? When I had mine, the only places I couldn't carry were bars, federal buildings, etc. Everywhere else that the general public went, we could carry. When did this change?

I do not think private business's can legislate, however, one
never knows with our State Gov.t anymore..There was a time when
most never figured they'd need a weapon and wouldn't carry one
concealed anywhere..I've gotten old enough that I'd have to rethink that, if nothing else but because of age and health..and
I can definitely see where a lady would feel more secure in some
situations..I see a lot of folks at the Gun Club on Sat's especially shooting..Also, I'm seeing parents teaching their children how to shoot assualt weapons..must have a generation that doesn't know about hunting..and targets..Don

Also, I am not 100% sure it was legit 30.06 signs...and when entering the mall area via the store there where no signs. I can only assume the antigun mangment is clueless about the laws and how to fully legally keep chl holders out. The whole time I was thinking "why the heck would anyone want to prevent the most law abiding citizens from having the ability toprotect themselves, their families, andor fellow man from evil?

Nope, there has been the 30:06 rule in place since Texas' CHL inception....

+1, just take your business somewhere else. But let them know via email or letter that you are going to shop somewhere else. Even if we all stopped going to that specific mall because of their anti-gun stance, it doesn't do us any good if we don't all tell them why. They could think they are loosing business because of the parking, lighting, food, etc . . . . . .

+1. There are businesses and buildings that have 30.06 displayed. One of my customers' buildings (multi floor, multi tenant) recently put up a very small 30.06 sign the size of a 4"x6" card. I was with my customer, and didn't have anywhere else to go, anyway. But the next time I went in, I unholstered. I was told by 2 CHL instructors, that their intent is there, and if you were caught (which shouldn't happen), they could still try to prosicute you, and it could cost you lots of money defending it, whether right or wrong.

Chad - how'd they get the one inch lettering on a 4"x6: card, not a legally binding posting of the 30.06 if it does not have the 1" lettering.

Correct. The lettering was very small, all the literature fit on a 4x6 card. It wasn't compliant to 1" lettering. But... when talking to some CHL instructors, if they went after you, you should eventually win a case against you, but it would cost you money to defend yourself. He said the intent was there to prevent CHL carriers, even though they didn't have it posted properly. He said you are taking a risk carrying in a place like that.

Quick story- A few years ago I went to a Haverty's warehouse to pick up some furniture my wife and I had bought. As I grab the handle of the door to go into the warehouse office, there was a small card, about the size of a 3"x5" index card with the 30.06 literature posted in the window next to the door handle. I was carrying, and stopped and thought (4 letter word here) for a minute. I desided to go back to the truck and unholster, while loosing about 4 to 5 spots in line. When it was my turn, I asked to speak to the manager on duty. When we spoke, I informed him of the improper sign. We talked about it, and his management put up the small sign. He said he had other guys complain to his employees about it and a few left angry. I told him why. I told him I would no longer buy any furniture at Haverty's because of this sign and asked him to pass this message on to mgmt. He said he would. No clue if they took it down or not.

Unfortunately, it will take someone getting killed, before retailers change. It will take the murder of a person that disarmed themselves, and a subsequent law suit and judgement, to get their attention. I predict it will eventually happen but it might take awhile.

My bad, went and read the title 7 chapter 30 and it does mention "card".

Sec. 30.06. TRESPASS BY HOLDER OF LICENSE TO CARRY CONCEALED HANDGUN.
(a) A license holder commits an offense if the license holder:(1) carries a handgun under the authority of Subchapter H, Chapter 411, Government Code, on property of another without effective consent;
and(2) received notice that:
(A) entry on the property by a license holder with a concealed handgun was forbidden;
or(B) remaining on the property with a concealed handgun was forbidden and failed to depart.

(b) For purposes of this section, a person receives notice if the owner of the property or someone with apparent authority to act for the owner provides notice to the person by oral or written communication.
(c) In this section:
(1) "Entry" has the meaning assigned by Section 30.05(b).(2) "License holder" has the meaning assigned by Section 46.035(f).
(3) "Written communication" means:
(A) a card or other document on which is written language identical to the following: "Pursuant to Section 30.06, Penal Code (trespass by holder of license to carry a concealed handgun), a person licensed under Subchapter H, Chapter 411, Government Code (concealed handgun law), may not enter this property with a concealed handgun";
or
(B) a sign posted on the property that:
(i) includes the language described by Paragraph (A) in both English and Spanish;
(ii) appears in contrasting colors with block letters at least one inch in height;
and(iii) is displayed in a conspicuous manner clearly visible to the public.


This make no sense at all! But when was the last time legislation made sense? 1789 would be my guess.

Another thing...why require to be in spanish??? You can't have a CHL unless a legal US citizen right? That being the case how can you be a legal US citizen and NOT understand the language in which country you are residing and becoming a legal citizen of???????

If you do not use a main mall entrance, enter through a store and walk out into the mall and there is NO notice, What then?

If it's like most trespass situations, they have to deliver notice, and give you a chance to leave. I asked a mall cop in a different state about it, his response was, we just ask them to leave
