Last year our neighbors were riding the fenceline but I didnt think much about it since I didnt get to hunt much last year. Well, opening day of bow season they were at it again...riding the fenceline, walking the fencline, riding horses, fixing fence before daylight, etc. We took pics and video and then we called the gamewarden. We decided not to press charges as long as they agreed not to do it again. I talked with our other neighbor who is a mutual neighbor with them and he told me that they havent stopped. They talk with them periodically and they are upset that we called the GW and they have been thinking of ways to mess with us since we called the GW on them.

I am wanting to know what our options are. We will be back out this weekend and I want to know what I can do and what I cannot do. I dont want to even entertain the idea of anything illegal but I want them to stop.

We have pics and videos from the bow season opener as proof and we intend on taking our video cams this weekend as well.

Maybe just go talk to them in a civil manner?

Were they intentionally harassing you opening day? Or were they simply.working on THEIR property?

Perhaps before you called the GW, you should have been a good neighbor and spoke to them directly.

Coincidentally, people do work when theyre off from their jobs. This is also when people hunt. I personally think you may have jumped the gun.

I didnt jump the gun on anything...

They were not fixing sh%t. I videoed them and took pics. They were intentionally harrassing us. They told the GW that they were fixing fence. Well, who in their right mind fixes fence(that is brand new) by riding their rhino 35mph up and down it, then walks it popping the top strand? Who rides their horse up and down it 30 minutes before dark while talking on their cell phone? Who fixes fence an hour before daylight by throwing brush against it and kicking the T posts?

The answer to all questions... NO ONE

The GW told us that this isnt the 1st complaint that he has had on them.

Unfortunately, I hunt on 80 acres therefore no matter where I hunt there is a fence line in sight. I only bowhunt. There are a couple of box blinds on the place but neither even have back windows(and this faces their property).

I think it is real dam convienent that they also ride their rhino and new 4 wheeler at the same time my feeder goes off.

They have been doing the same thing to our other neighbors. They popped off and told them that they were pissed that we called the GW and they want to screw with us. They also told them that they go over to their place just to see if we are there.

I have no problem with someone who is working on their land and I so happen to be hunting but trust me, they are working on 1 thing...scaring the deer off, and they seem to be doing a pretty good job of it.

It isn't hunter harassment if that is something they do on a regular basis.

Now if they are doing it only to mess with you, that is a different story.

They only do it when we or our neighbors are hunting. I hunt a free place as the landowner in a great friend and he lives in Jersey and wants us out there. There is another guy that hangs out there quite a bit, in fact he is there every day doing odds and ends around camp. He watches for them. Our camp is up on a hill and from our camp you can see almost their entire property. They never leave the house area until deer season rolls around.

I simply wanted advice from folks who may have dealt with issues like this before.

All you can do legally is call the GW when it starts again. I imagine he will cite them this time. Good luck.

One thing that I have learned is that there is a big difference between leasing land and owning land. If you lease it, it is much easier to relocate. They own the land, so they aren't going anywhere. Even if you get the charges pressed, then what? Chances are they are going to start doing actual damage and it will cost more in the long run. It will be a constant battle that you will never win.

Wish it was different, but seems that most the time in situations like this, the person that "has it coming" never gets it.

If they are dumb enough to cause damage then let them do so. I hoep they are that dumb. $$$ isnt an issue with our landowner and will pursue to the extent of the law just to prove a point.

I havent been back out since bowseason opener but I will be back again. They cannot see my bow stand but I can see them. I will have my camera documenting everything. I will also have a civil conversaiton with them afterwards. I am usually cool headed about things and I will keep my cool with them but I am not afraid to use the law to my advantage.

And if charges are pressed, then what? They know we are not playing games. We will continue to press charges until it stops.

They know where my feeder is. Unless they have trespassed then there is no way they know it is there. I have a gun blind there that they can see. Little do they know, it has never been occupied.

I would not give them the satisfaction of winning.
It would not even cross my mind. Talk to them in a person. Explain them, that they are more vulnerable than they may assume. (Especially if it their homestead and have their horses).
Ask them if they know what happens to people that seed the wind.
(I would be concerned to ride a horse next to the fence where guy is bowhunting. He may not be all that accomplished).
Accidents happens during the hunting season.........
No phone calling that they may record unless it would be very polite, informing them to stay of the fence line during the early morning and evening hours, since you have a youngster hunting with a highpowered rifle. Of course you record such a call yourself.

Test their horsemanship (aka riding skills) with a well timed volley at your newly constructed & camouflaged "fenceline" rifle range. I hear AFV offers up to $100,000 for a really funny video. Yes, the old tongue is lodged firmly in my cheek.

Don't know how open the pasture is, but you may look into concealing all evidence of hunting on your place. If they think you have packed up and left, they may not harass you anymore. The sound of a feeder going off may be difficult to cover on 80 ac. Good luck!

I would just ask them what they have against you hunting on YOUR land? Are they animal rights freaks? Or are they just mental?

You say they are pissed you contacted the GW, which is why they are doing it, well why did they start in the first place. Seems odd...

If I understand him correctly, they are angrier now that he has contacted the GW...

Screw that game warden nonsense. If he is as lazy as the rest of 'em... Plus they are overworked with the size of their appointed area. If you are serious about getting something done go DIRECTLY to the county courthouse and file a complaint with the county attourney. Have your evidence in order and present your case. Considering this, you are going to the next stage of war with these clowns, but it sounds like you personally are already there. Let the law pursue it, but plan on moving to a new hunting area because of your actions. Your loss, will be future hunters' gain with dealing with crap like this. Someday, the next hunters on this property WILL thank you!

Wow just looked up Hunter Harassment Penalties in Texas. It is a Class B misdemeanor.-- An individual guilty of a Class B misdemeanor is subject to a fine not to exceed $2,000 jail for a term not to exceed 180 days. Good luck FoxTrot.

Even if he does, its a class b misdemeanor. A lawyer WILL get it thrown out. And if not, pay a fine and continue on.
