that doesn't even make sense. the issue at hand is how a innocent hunter is being treated like trash. If you are saying that Barrack is a good ol' boy then fine. I am not sure he is a hunter though. Post that info, i would like to invite him hunting on my place.

BS....it takes a lot of hard work and money to buy corn all year, plant crops, keep the feeders working. And then somebody comes in to harvest your crop for you ? Throw the book at him. He's a thief and is endangeing others life by hunting on their property.

poor guy, he was just a good ol' boy trying to feed his family and that jerk went and called the GW. was there any signs that said no hunting? probably not. Thats the problem, all of these landowners too stingy to let people go and hunt. There are plenty of deer so what is the issue? Everyone is so quick to throw the book at this guy. he is a fellow hunter. respect that! Whatever.

There is no need to feed all year long unless the place has few deer. i suppose I have been lucky because all i do is change the betteries on feeders as their only servicing that they need. I buy quality stuff though so that may be why. As far as crop? well there is plenty of it and it isn't mine so if someone wants to take a few then im fine with that so long as they dont litter. It is the same way with my melons. If someone is starving and they want to come by and take a few then im ok with that. I never sell all of them anyway and some just rot away and get wasted.
Also i know there are extreme situations where a fellow huner could step on my toes and do things that could get under my skin, but i am human and that is simply my nature. Even so ive got plenty of land with plenty of critters. And no those with the opinion of sending a poor hunter to jail are not welcome. but if you can leave your ego in check and be a little more respectful to your fellow hunters then you are more than welcome to.

Said innocent hunter can hunt on public land for which he pays taxes and has the right to hunt, or he can do like the rest of the guys that don't own land and don't poach and lease the rights from someone who does own it, or do like myself and everyone else who doesn't poach and purchase your own land to do as you please under the rules. Otherwise he can bug off and take whats coming to him. See below and stay off my property.
Poaching is the illegal taking of wild plants or animals contrary to local and international conservation and wildlife management laws. Violations of hunting laws and regulations are normally punishable by law and, collectively, such violations are known as poaching.
It may be illegal and in violation because
The game or fish is not in season; usually the breeding season is declared as the closed season when wildlife species are protected by law. The poacher does not possess a valid permit. The poacher is illegally selling the animal, animal parts or plant for a profit. The animal is being hunted outside of legal hours. The hunter used an illegal weapon for that animal. The animal or plant is on restricted land. The right to hunt this animal is claimed by somebody. The type of bait is inhumane. (e.g. food unsuitable for an animal's health) The means used are illegal (for example, baiting a field while hunting quail or other animals, using spotlights to stun or paralyze deer, or hunting from a moving vehicle, watercraft, or aircraft). The animal or plant is protected by law or that it has been listed as extinct or endangered (see for example the Endangered Species Act for the USA or the Migratory Bird Treaty Act of 1918 and similar laws/treaties. The animal or plant has been tagged by a researcher.
Trespass to LandIn modern law the word trespass is used most commonly to describe the intentional and wrongful invasion of another's real property. An action for trespass can be maintained by the owner or anyone else who has a lawful right to occupy the real property, such as the owner of an apartment building, a tenant, or a member of the tenant's family. The action can be maintained against anyone who interferes with the right of ownership or possession, whether the invasion is by a person or by something that a person has set in motion. For example, a hunter who enters fields where hunting is forbidden is a trespasser, and so is a company that throws rocks onto neighboring land when it is blasting.
Every unlawful entry onto another's property is trespass, even if no harm is done to the property. A person who has a right to come onto the land may become a trespasser by committing wrongful acts after entry. For example, a mail carrier has a privilege to walk up the sidewalk at a private home but is not entitled to go through the front door. A person who enters property with permission but stays after he has been told to leave also commits a trespass. Moreover, an intruder cannot defend himself in a trespass action by showing that the plaintiff did not have a completely valid legal right to the property. The reason for all of these rules is that the action of trespass exists to prevent breaches of the peace by protecting the quiet possession of real property.
In a trespass action, the plaintiff does not have to show that the defendant intended to trespass but only that she intended to do whatever caused the trespass. It is no excuse that the trespasser mistakenly believed that she was not doing wrong or that she did not understand the wrong. A child can be a trespasser, as can a person who thought that she was on her own land.
Injury to the property is not necessary for the defendant to be guilty of trespass, although the amount of damages awarded will generally reflect the extent of the harm done to the property. For example, a person could sue birdwatchers who intruded onto his land but would probably receive only nominal damages. A farmer who discovers several persons cutting down valuable hardwood trees for firewood could recover a more substantial amount in damages.
Trespassers are responsible for nearly all the consequences of their unlawful entry, including those that could not have been anticipated or are the result of nothing more wrongful than the trespass itself. For example, if a trespasser carefully lights a fire in the stove of a lake cabin and a fault in the stove causes the cabin to burn down, the trespasser can be held liable for the fire damage.
Courts have had to consider how far above and below the ground the right to possession of land extends. In United States v. Causby, 328 U.S. 256, 66 S. Ct. 1062, 90 L. Ed. 1206 (1946), the U.S. Supreme Court held the federal government liable for harm caused to a poultry business by low-altitude military flights. The Court concluded that because the airspace above land is like a public highway, ordinary airplane flights cannot commit trespass. In this case, however, the planes were flying below levels approved by federal law and regulations, so the government was held responsible. Its activity was a "taking" of private property, for which the Fifth Amendment to the U.S. Constitution requires just compensation.
It may be a trespass to tunnel or mine under another person's property, to force water or soil under the property, or to build a foundation that crosses under the boundary line. Underground encroachments are usually an exception to the rule that no harm needs to be shown in order to prove a trespass. Generally, trespass actions are permitted only where there is some damage to the surface or some interference with the owner's rights to use her property.

thats the problem, they shouldn't have to go through all sorts of red tape, now it is a whole process like getting something done with the city. all sorts of steps that take place to get something simple done. that is a shame.

Sir, I disagree with you. I hunt on someone's else land because I asked for permission. The landowner lets me hunt for free, but I give him money anyway to show him that I appreciate being on his land. It doesn't hurt to open your mouth and ask the landowner. It's disrespectful to go on someone's land without permission. That's like someone breaking into my house and taking what is in my possession.

Why even mess with a lease when you can go hunt for free on the weekdays? Always be sure to leave a couple of empty beer cans, Taco Hell burrito wrapper and salsa packets in the stand.

I am not too sure I would have sneaked out of the deer blind to call the GW. Probably would have opened the door to a P226 with a TLR lit up on his face with a tiny red dot between his eyes with simple instructions to follow........
This guy was very lucky if you ask me.
Shhhhhhhh better to be quiet than remove all doubt..
