I beleive Ive read or heard that you can now only hunt the river bed area and not the flooded sloughs for ducks. Anyone have a definate answer?

But if you OWN that riverfront land......you can hunt any of the sloughs you want as long as they are on your property.

If the land is public hunting land, I would assume that it is perfectly legal.

(1) fishing or to fish and other aquatic life;
(2) a person who:
(A) owns the submerged land; or
(B) obtains the landowner's consent;

Common sense would tell me if your on a river inside a WMA or on water over WMA land, you would be under whatever that WMA's rules are related to hunting.

and how do you expect to be floating over flooded private land if the river is dry? scratch

Now if your straying away from the original question asking if a particular river is navigable or not, there may not be an easy answer.

I guess your asking one of the two.

Can you hunt the land next to a creek that is sometime dry if you own it.

If you own the land you can do whatever you want on it.

or can you hunt in a creek bed as long as you do not touch the surrounding property etc etc.

You have to find out if the creek your thinking of is a navigable water way. You find that out through the state I believe there is a list.

I know that if there is a creek flowing into the river you can hunt the creek , but there is laws that regard to that. Now if flooded timber or a slough is connected to the river shouldn't you be able to hunt it? I can see why this law is in affect but I also am wondering what the problem would be with it.

Thats what Im trying to figure out.. If the river breaks the bank and floods timber.....Can you HUNT the flooded timber? At the point of a river breaking a bank, even though it does flow onto private property...isnt it still public waters?

Depends on if your quoting federal law, or state law.

Federal supersides State. But State law say's if that property is marked. Be it a sign or a painted tree, and you corss that line to hunt, or even let your shot cross that property line. It is illegal. Wierd deal is.. It isnt for fishing.

Someone with deep pockets needs to fight it to the state supreme..
