If I buy a firearm from an out-of-state dealer or individual, is the local FFL dealer supposed to collect Texas sales tax?

How can I convince the local dealer of this? Is he wanting to charge tax on the transfer fee or the purchase price of the firearm ? If the store you bought it from also has a store in Texas they will charge sales tax.

How can I convince the local dealer of this? Like Brandon said if its an out of state dealer the only thing he can charge you tax on is his particular transfer fee.

The only way they can charge tax is if they have a sotre in Texas! Call the comptroller !!

If that is true, you need to find another FFL and if you dont your the DB.

That's in a bulletin we got from State Sales tax a year or two ago actually.
When you purchase a firearm, you can't actually legally purchase it from out of state. You are actually purchasing it here, where you do the paperwork.
It's a definite irony. I see both the buyers point of view and the state's/fed's.
I don't think its going to matter, most states are taxing internet sales from other states anyway, and it's coming here soon too.

Every once in a while I hear of an FFL holder doing this. I highly doubt he is giving the "Tax" he collects to the state, as he's not even involved in the actual sale of the firearm. It would be very difficult to account for that, I suspect.
Finding a new FFL is about your only good option. Plenty of them realize that shady/greedy practices tend to run off customers that buy other stuff when they are willing to do a reasonably priced FFL transfer paperwork mostly as a service.

Yep. Technically, individuals are responsible now for paying the tax to the state on items purchased out of state. It seems it's only being done by a very few FFLs that seem to have a bone against internet sales & not to comply with the Comptroller.

I just hope it doesn't change the ability of non-licensees to pruchase from dealers out of state. But when government gets involved in money matters, they usually prevail.

Individuals are suppose to pay sales tax on anything they purchase out of state, but nobody does it.
My wife's only thing is it can't stare at her when she is eating or sleeping!

If its paid in full when it arrives at your dealer, all your on the hook for is transfer fee, that has been my experience.

Legally an individual can't BUY it from an out of state dealer. YOu are actually buying it when you pick it up at the FFL, in your home state.
