A friend of mine lost his male Brittany on Saturday, June 21. Dog escaped from his backyard while he was gone for the weekend. He's a male, about 2 yrs old. Please contact me if you have any information. He's checking the local pound. Thanks!

Thanks Garrett - Good news - dog found at the Fort Worth pound. Bad news - he had to pay $110 to claim him. This included shots (all of which he didn't need), a microchip (not necessarily a bad thing), and the fine. The worst news was they told him he had to have the dog neutered in 30 days or they would send him a "summons." Whatever that means. What is becoming of our state? I tried to look up the regulations for Fort Worth and there is no law/regulation that speaks to all dogs have to be spayed/neutered. In any case, thanks everyone.

good news that the dog was found, what happens if he does not neutethe dog? are they going to come to the house and check to make sure it was done? I dont see that happening

I have no idea what they might do, they tried to make him believe he'd be called to court via the "summons." I think he's going to just ignore it and see what happens. Thanks again.

Ignore is normally not a good option especially if he did not have a liscense or other paperwork. I hope all works out. Glad he got his dog back and maybe they will be reasonable but ignoring will not encourage a reasonable response.

Will keep you posted. The guy was glad to have the dog back, but he was really ticked with the personnel at the pound and the $110 fees. They were real smart arses. The way he talked, anyone could walk in there and claim any dog they wanted without any proof that the one they picked was their dog.

Here's the City of Fort Worth ordinance:
Sec. 6-50. Mandatory spay/neuter of unrestrained dogs and cats.
(a) Mandatory spay/neuter following impoundment. Effective January 1, 1997, the owner of a dog or cat which has been impounded for being at large shall have the animal spayed/neutered within thirty (30) days following the animal's release from impoundment.
(e) Affirmative defense. In a prosecution for a violation of subsection (d) it is an affirmative defense that:
(1) At the time of the animal's impoundment;
a. The animal was registered with a national registry or was a sporting dog, livestock dog, or working dog; and
b. The person was a member of a national breed club, local breed club, local all-breed club, or sporting or hunting club; and the person had not sold twelve (12) or more intact dogs or cats in the preceding year.
(2) At the time of the animal's impoundment it was wearing a current city license tag, valid for that animal, and had not previously been impounded for being at large; (3) The animal was at large at the time of its impoundment due to a vis major; or
(4) The animal was at large at the time of its impoundment due to fire or due to the criminal or negligent acts of a third party who was not residing at the animal owner's residence. At trial, evidence of a fire or the criminal or negligent acts of a third party may be presented in one (1) or more of the following manners:
a. A certified copy of a city police or fire report verifying the incident; b. The affidavit of city police or fire personnel with direct knowledge of the incident; or c. The testimony of city police or fire personnel with direct knowledge of the incident.
The animal care and control manager is authorized to exempt an animal's owner from the requirements of subsection (a) if the owner proves to the satisfaction of the animal care and control manager that the animal met one (1) of the conditions specified in subsection (e) below. If you do not meet the affirmative defenses above and the animal is not sterilized within 30 days of you reclaiming it, the City will issue a citation for non-compliance with ordinance Section 6-50- Mandatory spay/neuter of unrestrained dogs and cats. You can then contest the citation in municipal court or pay the window fine for the violation.

It sounds like your friends answer needs to be: a) he is a registered Brittany with AKC and he is a hunting dog AND b)The owner is a member of a sporting/hunting club (DU/ Delta/ Quail Forever/...) and he has not sold more than 12 intact dogs over the last 12 months.
THEN he needs to get the dog registered with the county or city in which he lives and put the tag on the dog's collar.

I'd move! That's still B.S. but it sounds like he will get out of it. No way would I neuter/spay one of my dogs unless for health reasons. He can come stay at my house if he needs to then he can say he got rid of the dog to get them off his back. As far as the $110, that's better than not getting him back at all.

Looks to me like he has a ton of outs in the statute. It will take a little work on his part. But a visit with the supervisor by phone or in person might solve the problem. It is sure worth the try depending on his facts.
