Guys I hate to tell you this but I sell guns all the time in my work and you have to let the state know you are selling a hand gun with the serial # you can get the paper work on line. If some one buys that gun and kills some body they will trace it back to you and the old sorry I sold it trick will cost you a ton of money to get out of. Just my 2 cents here but I would do it the right way. And do the same if it is stolen and let law enforcement know as well.

There, is the qualifier, In YOUR Work.

By saying that, that takes a face to face deal between individuals out of the picture, you are in the busines of selling firearms/pistols.

Two private individuals are not held to the same standards, at least not yet.

Someone in the business does have to work under a different set of rules, one of the reasons so many folks want to try and stop the indidvidual face to face market among private individuals.

As has been said on similar threads such as this, unless the seller just wants to get something to verify that they sold the gun to a certain individual, there is no paper work required.

Actioneer1 I hate to inform you that you are wrong with that statement. I have sold a gun on this forum and it was stolen from the purchaser, and it was used in a hommicide. I recieved a call from the US District Attourney(sp?), and I explaind the situation of the sale and whom I sold the gun to and gave them the info on how to contact them. That was the last I have ever heard about the case. I have even tried to look into it and can't find any information out about it. Now that being said I will never sell another gun to an individual. I understand that there are instances when something is out of your controll but I do not like the feeling that I sold the firearm.

Well guys if there is no paper work for you then why take the time to buy one at the gun store and have a background check BY THE STAE thta takes 2 to 3 days to get back if it's less of a pain to buy it off the street. All I can say is if you (THINK) you need than don't do it simple as that I was just telling you guys how to do it right.

No, you are telling us how YOU HAVE TO DO IT, in your line of work, period.

Individual, face to face sales, do not require onre damn thing, that is why the anti forces are so hot on getting personal, face to face firearms transactions of any kind outlawed.

I ain't gonna sell a gun to someone that does not appear trustworthy, do you think people out to break the law feel that same way? Hell No they don't.

All the paper work does, is just like a lock on a gate, keep an honest person honest.

The paper work also gives the PTB's someone to blame, you have the paperwork, because you sold the gun.

I may have a gun I bought from another individual that bought it from another individual, and I sell it to someone else. and my name and adress appears no where on the history of that gun. How The Hell Am I Gonna Get In Trouble?

Seems to me, that the only time folks get in trouble with the authorities, is when they try their damndest to follow the rules.

Could that mean that there is POSSIBLY something WRONG with the system.

Simply Amazing.....and I know....your going to say this is apples to oranges.....I know...

What is wrong with keeping and honest person honest.....
What is wrong with making sure you don't sell to some guy that looks nice and honest but then kills 5 people with it....
How many serial killers or murderers actually looked like they would commit a crime.....
Just curious.....

Nothing wrong with having to have a background check...
nothing wrong with that one damn bit......

Do we worry sometimes if we are buying stolen goods...probably.....
Do we worry that the gun was committed in a crime...
probably.....
So what is wrong with CYA.....

Paperwork is required. I was under the impression all of you were doing that. State law does not mandate it the Feds do though. I have only bought from a midget in Odessa, and he is easy to track down.

It's some what like buying/selling a car. The title must be transferred to the new owner.

If the original owner/seller of the gun wants his name removed from the registration, then it must be "transferred" to the new owner/buyer.

Gun show sales are a good example, where guns are bought, sold, or traded. But if that owner/seller/trader has registered the gun at any time in his name and wants it out of his name, then the transfer of ownership must also be completed to register the new owner.

Could someone please post a link to the law concerning the record keeping of private handgun sales! I searched the ATF website and had no luck at all finding any law concering it!

From what I understand it is currently illeagel for government agencies to track private sales of firearms!

No it's not.

I have sold two handguns to private individuals over the past few years and NO paperwork changed hands.

IF, a person is concerned, then they can request that the buyer sign something, but there is no law stating that two private individuals can not buy/sell a gun.

Folks you are talking here.

That is why the folks want to close the "Gun Show" loop hole.

Wake up people, face to face transactions with firearms have been happening for YEARS.

If you are concerned, go thru the process.

Roy, I have sold about a half dozen hand guns face to face with individuals over the pat 20 years or so and have not had one problem nor have I ever had anyone contact me in any way on those sales.

not sure about that, but if you buy a weapon from me, your gonna sign two items...a 4473, and a bill of sale...its called CYA, cause you never really know what will happen..shoot, the weapon could get stolen the next day..

So based on those links it is not required by law to keep records of private sales between private individuals in the same state!

It does say to check local laws though!

You still missed what jdicky was saying. He said if you want it out of your name, you need to transfer, he didn't say transfer was mandatory. Which it isn't in the state of TX.
