The ATF’s proposed rule expanding who is “engaged in the business” of selling firearms is being lauded by anti-gun groups like Giffords, which says the rule “moves us closer to universal background checks than we’ve ever been,” while the National Shooting Sports Foundation is panning the new proposal as yet another example of executive branch overreach by the Biden administration.

I was at a gun show yesterday and heard a couple of guys talking about a new definition for Federal Firearms Dealers. They both agreed that the law was already in affect.
They claimed it is now law that anybody who sells a gun for profit is required to have an FFL.
Is there any truth in this?

I agree, but the problem I have is not knowing when and where to see the black and white.
I don’t think I have time to read the ATF book every day to see if anything is new.
If anyone here could tell me how to go about finding changes in the ATF regulations and being notified of them I sure would appreciate it.

Q: What does it mean to be “engaged in the business of dealing in firearms”?
A: Under federal law at 18 U.S.C. § 921(a)(21)(C), a person engaged in the
business of dealing in firearms is a person who “devotes time, attention
and labor to dealing in firearms as a regular course of trade or business to
predominantly earn a profit through the repetitive purchase and resale of
firearms.” In 2022, the Bipartisan Safer Communities Act (BSCA) revised
this intent language to replace “with the principal objective of livelihood and
profit” with “to predominately earn a profit.”
Section 921, as amended by BSCA, defines the term “to predominantly earn
a profit” to mean “the intent underlying the sale or disposition of firearms is
predominantly one of obtaining pecuniary gain, as opposed to other intents,
such as improving or liquidating a personal firearms collection.” 18 U.S.C. §
921(a)(22). Section 921 explicitly provides, however, that the term “engaged in
the business,” as it applies to a dealer of firearms, does not include a person
who only “makes occasional sales, exchanges, or purchases of firearms for
the enhancement of a personal collection or for a hobby, or who sells all or
part of his personal collection of firearms.” 18 U.S.C. § 921(a)(21)(C).

I really do appreciate the interest and the links that were sent to me. Is there a way to know if what you read is current I mean like if the law changes today, do they send out a notice or anything?

Abolish the ATF. An agency that was purposefully created to infringe, they are the most trigger happy lot of thugs out of all the government agencies combined.

Let the real cops deal with the real criminals. The ATF is spinning their wheels trying to justify their existence by infringing on the rights of law abiding citizens. They are a tool that tyrannical leaders use to flex on the law abiding citizens that they fear most.
